These Service Terms (“Terms”) govern yacht detailing services provided by Elite Yacht Detailing (“we,” “us,” or “our”) to vessel owners, captains, and authorized representatives in Southwest Florida. By requesting a quote, booking a service, or allowing our team aboard your vessel, you agree to these Terms.
1. Services & Scope
We provide professional marine detailing, correction, protection, and related surface-care services as described in your written proposal or service order. Any work outside the agreed scope requires written approval and may affect pricing and scheduling.
2. Scheduling & Access
You are responsible for providing safe, timely access to the vessel, including marina clearance, dock availability, shore power or water if required, and notification of any known hazards. Delays caused by restricted access, weather, or third-party holds may require rescheduling.
3. Vessel Condition & Disclosure
You agree to disclose prior repairs, aftermarket coatings, tape residue, oxidation severity, teak condition, and any areas of compromised gelcoat or clear coat. Results depend on existing surface condition; we do not guarantee outcomes beyond the agreed service description.
4. Pricing & Payment
Quotes are valid for the period stated in writing. Final pricing may change if vessel size, condition, or scope differs materially from the initial assessment. Payment terms are due as stated on your invoice unless otherwise agreed in writing.
5. Weather & Safety
We may pause or reschedule work for lightning, high winds, unsafe dock conditions, or other circumstances that create risk to personnel or the vessel. No fees apply for weather-related rescheduling initiated by us.
6. Limitation of Liability
To the fullest extent permitted by Florida law, our total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of use, charter revenue, or diminution in value, except where prohibited by law.
7. Your Property
Remove personal items and valuables before service. We are not responsible for loss or damage to unsecured personal property left aboard during detailing.
8. Cancellations
Cancellations made less than 48 hours before a scheduled appointment may incur a fee to cover reserved labor and travel within Southwest Florida. Repeat no-shows may require prepayment for future bookings.
9. Photos & Portfolio Use
Unless you opt out in writing, we may photograph completed work for portfolio, marketing, and quality documentation. We will not publish registration numbers or identifying marks you ask us to exclude.
10. Governing Law
These Terms are governed by the laws of the State of Florida. Disputes shall be resolved in Collier County, Florida, unless otherwise required by applicable law.
